Hon. Colonial Secretary,

With respect to the question of a Court

of Appeal consisting of three Magistrates, I think it might be

established provided there is no appeal as of right and that an

appeal should only be allowed by leave of the Magistrate who

tried the case. There should also be a recognizance entered

into by the appellant to pay the costs of the respondent in

the event of the appeal being dismissed. The Court should also

have power to award costs, the maximum amount not to exceed

$100.

The costs of an appeal from the deci-

-sion of a Magistrate to the Supreme Court of bongkong in its

Appellate Jurisdiction is so costly as to be practically pro-

-hibitive except to the very rich.
